Punishment for Delinquency

Juvenile delinquency is explained by Arora (2018), as the engagement in antisocial and criminal behavior by persons that are below 18years. Persons who commit bad behaviors below the age of 18 years, they are usually treated differently as compared to adults. Over the years, delinquent punishment has undergone tremendous transformation to where it has clearly structured part in the criminal justice (Arthur & Waugh, 2008).

This paper examines delinquency punishment in 21st century and colonial period, to explain the best time that Jim should back to start over again.

Jims Case

As a young person who is constantly inclined towards finding trouble, it is important to make a right decision with regard to the time he can travel back and start all over again. When making this decision of turning back the hand time, Jim should first understand the kind of punishment administered to juveniles whenever they go against the law. This can help him to make the right choose and live accordingly to avoid trouble.

  Colonial period

The U.S colonial period dates back in the 17th century when the U.S was still subdivided into colonies (Death Penalty Information Center, 2018). At the time, the United States Union had not been established, and therefore, every state acted independently. This means, every state made its unique laws based on agreement of the leaders of the colonies and the challenges facing the colony. At the time, there was not elaborate criminal justice, and therefore the children were treated based on cultural understanding of the settlers. Additionally, it is important to understand that offenses have also changed over time, whereby juvenile offences in that colonial period included what would rather be normal in 21st century such as going out with friends (Death Penalty Information Center, 2018).

The crime of breaking and entering with the aggravating circumstance assaults would be treated differently during colonial period and during the 21st century. In the colonial period, the punishment administered to juveniles after an offence was based on religious guidance. According to the Death Penalty Information Center (2018), a crime like breaking and entering with the aggravating circumstance assaults would directly attract death penalty. The colony of Massachusetts was one of the colonies that established death sentence upon juvenile offenders through its Stubborn Child Law in 1641. Therefore, if Jim goes back to the time of colonial in Massachusetts, then he would directly be sentenced to death. Because of the magnitude of crime, Jim would also face harsh treatment which including canning and mutilating, and whipping for the crime. Certainly, this crime would attract harsh sentencing in the colonial period, because the punishment was strongly based on puritans and other religious standing of the settlers. Although Jim would not be sentenced to death for the crime, he would still risk death before of the level of beating offered as disciplinary measure (Arthur & Waugh, 2008).

Although there have been much changes in the 21st century, the states are still independent in making decision with regard to treatment of young offenders (Arora, 2018). However, much has changed with regard to forms of crimes where some crimes such as idling and walking out with friends are no longer categorized as crime. However, breaking and entering with the aggravating circumstance assaults would still be a crime and therefore treated differently in various states.

21st century             According to Arthur & Waugh (2008), under both Federal and state laws, when a person of less than 18 years commits a crime, it is termed as a delinquent. However, the child is taken through the court processes where the juvenile is tried in the court of law. In the 21st century, the U.S has established
